H4 EAD: Eligibility, Documents, Fee and How to Apply in 2026
- An H-4 spouse qualifies if the H-1B worker has an approved Form I-140 or holds H-1B status under AC21 sections 106(a) and (b).
- The Form I-765 fee is $520 by paper as of October 14, 2026; category C26 is not on USCIS's list of categories that can be filed online.
- USCIS changed I-765 filing addresses on October 7, 2026 and accepts mail sent to prior addresses if postmarked by November 9, 2026.

An H-4 EAD is a work permit for the husband or wife of an H-1B worker. You qualify if you hold H-4 status and your H-1B spouse either has an approved Form I-140 immigrant petition or has been granted H-1B time beyond the six-year limit under the law known as AC21. You apply on Form I-765 under category (c)(26), the fee is $520 on paper as of October 14, 2026, and you may not start working until the card is approved.
This page explains who is eligible, which documents USCIS asks for, how to fill in and file the form, and what the card allows. It is general information, not legal advice. The official form page is uscis.gov/i-765, where you can download the current Form I-765 PDF and instructions free of charge.
What an H-4 EAD is
H-4 is the dependent status for the spouse and unmarried children under 21 of an H-1B, H-2A, H-2B or H-3 worker. H-4 status by itself does not allow employment. Since May 26, 2015, a DHS regulation has let certain H-4 spouses of H-1B workers apply for an Employment Authorization Document (EAD, Form I-766). The regulation is at 8 CFR 214.2(h)(9)(iv), and the work authorization category is 8 CFR 274a.12(c)(26), which is why the card and USCIS notices say "C26."
The policy reason DHS gave in 2015 was the long wait for employment-based green cards: families in which the H-1B worker had already started the permanent residence process were living for years on one income.
Who is eligible
USCIS states two alternative conditions. You are eligible if you are the H-4 spouse of an H-1B nonimmigrant who:
- is the principal beneficiary of an approved Form I-140, Immigrant Petition for Alien Workers; or
- has been granted H-1B status under sections 106(a) and (b) of AC21, the American Competitiveness in the Twenty-first Century Act of 2000. Those sections let an H-1B worker stay past the normal six-year maximum when a permanent labor certification or an I-140 was filed at least 365 days earlier.
| Your situation | Eligible for an H-4 EAD? |
|---|---|
| Spouse's I-140 is approved (any employment-based category) | Yes, under the first condition |
| Spouse's I-140 is pending and H-1B is still within the first six years | No, not yet |
| Spouse is in a seventh-year or later H-1B extension granted because PERM or the I-140 was filed 365 days or more earlier | Yes, under the AC21 condition |
| Spouse has only a PERM filing and is within the first six years | No |
| You are an H-4 child | No. The rule covers spouses only. |
| Your spouse holds H-1B1 (Chile or Singapore), H-2A, H-2B or H-3 status | No. DHS states that H-4 dependents of H-1B1 workers are not eligible to apply; the rule covers H-1B spouses. |
You must hold valid H-4 status yourself, and your spouse must be maintaining H-1B status. The EAD rests on both.
If your spouse has not reached the I-140 stage, the first steps are usually a prevailing wage request and PERM labor certification. See PERM processing time for current waits, and EB-1 requirements or EB-2 NIW for categories that skip PERM.

What the card lets you do
- Work for any employer. The C26 EAD is not tied to a sponsor, an occupation or a number of hours. The 2015 rule placed no restriction on the type of employment, which is why H-4 EAD holders can change jobs, hold more than one job, freelance or start a business.
- Get a Social Security number. Form I-765 includes questions that let you request a Social Security card in the same application.
- Complete Form I-9. An unexpired EAD is an acceptable List A document for employment eligibility verification.
Searches for "H-4 EAD jobs" often assume there is a special list of employers. There is not. Any U.S. employer can hire an H-4 EAD holder without filing anything with USCIS. The practical point to raise with an employer is the expiration date, because renewals no longer carry an automatic extension (see below).
How long it is valid
USCIS says the expiration date on the card "should be the same date as the expiration date on your most recent Form I-94 indicating your H-4 nonimmigrant status." Because the I-94 normally tracks the spouse's H-1B approval, an H-4 EAD is typically valid for up to three years at a time, and less if the H-1B period is shorter.
Documents required for an H-4 EAD
USCIS lists the evidence in a chart on its H-4 EAD page and in the Form I-765 instructions (edition 08/21/25).
| You must show | Documents USCIS accepts |
|---|---|
| Your H-4 status | A copy of your current Form I-797 approval notice for Form I-539, or a copy of your Form I-94 showing admission in H-4 status or your latest approved extension |
| Your identity | A copy of your last EAD, if any; or the biometric page of your passport; or a birth certificate with photo ID; or a visa issued by a foreign consulate; or a national identity document with photo |
| Your marriage to the H-1B worker | A copy of your marriage certificate |
| Basis: approved I-140 | A copy of the Form I-797 approval notice for the I-140 |
| Basis: AC21 extension | Copies of your spouse's passports, prior Forms I-94, and current and prior Forms I-797 for Form I-129, plus proof that PERM or the I-140 was filed at least 365 days before the extended period began (for example, a Department of Labor status printout or the I-140 receipt notice) |
| Photos | Two identical 2-by-2-inch passport-style color photographs |
| Translations | A full English translation, certified by the translator as complete and accurate, for any foreign-language document |
If you cannot get the I-140 approval notice or the AC21 evidence, USCIS says it may consider secondary evidence, such as the receipt number of the approved I-140 or of your spouse's most recent I-129 extension. The agency warns that failing to provide information about the H-1B spouse "may result in a delay in the adjudication or denial."
Photo requirements
The Form I-765 instructions require photos that are:
- in color, taken recently, identical, 2 by 2 inches;
- on a white to off-white background, printed on thin paper with a glossy finish;
- full face, frontal view, with head height of 1 to 1 3/8 inches from the top of the hair to the bottom of the chin;
- bare-headed unless you wear headwear required by your religious denomination;
- unmounted and unretouched, with your name and A-Number (if any) lightly printed on the back in pencil or felt pen.
USCIS warns that mounted or digitally edited photos "will delay the processing of your application" and may lead to an in-person identity check. Separately, under a Policy Manual rule, USCIS can reuse a photo taken at a prior biometrics appointment only if it is no more than 36 months old, so some H-4 applicants are now scheduled at an Application Support Center even after sending photos. Attend any appointment you are given; a missed one can end in denial.
H-4 EAD fee
| Item | Amount | Notes |
|---|---|---|
| Form I-765, paper filing | $520 | Applies to initial, renewal and replacement cards |
| Form I-765, online filing | $470 | C26 is not on the list of categories USCIS accepts online |
| Form I-539, if you also need to extend or change to H-4 | $470 paper / $420 online | Separate payment |
| Biometric services fee | $0 | USCIS folded biometrics costs into the form fees in its 2024 fee rule |
Source: USCIS Form G-1055 Fee Schedule, edition 10/07/26, checked October 14, 2026. The same $520 applies to an H-4 EAD renewal. The additional fees created by the 2025 budget law (shown on the schedule as "Pub. L. 119-21" fees) apply to asylum, parole and Temporary Protected Status categories, not to C26.
The fee schedule tells mail filers to pay by credit, debit or prepaid card using Form G-1450, or directly from a U.S. bank account using Form G-1650. An applicant who qualifies for an exemption from electronic payment must include Form G-1651. USCIS rejects packages with the wrong fee. Use the USCIS fee calculator on the day you file.
How to apply for an H-4 EAD: step by step
- Confirm the basis. Get a copy of your spouse's I-140 approval notice from the employer or attorney, or assemble the AC21 evidence.
- Check your I-94. Download your most recent I-94 from the CBP website and compare its end date with your spouse's H-1B approval. If your H-4 period is about to end, you also need Form I-539.
- Download the current form. USCIS is accepting the 08/21/25 edition of Form I-765. A 09/15/26 edition exists, but USCIS says it is not accepting it while a September 14, 2026 court order in Massachusetts is in effect. Check the edition date on the form page before printing.
- Complete the form. In the eligibility category question (Item Number 27), enter (c)(26). In Item Number 29, enter the receipt number from your spouse's most recent Form I-797 for Form I-129. Select "initial permission," "replacement" or "renewal" as it applies.
- Sign it. USCIS rejects unsigned forms.
- Assemble evidence in the order of the table above, with photos in a small envelope.
- Add payment and, if you want a text or email when the lockbox accepts the package, Form G-1145.
- Mail it to the right address (next section) and keep a full copy.

Where to file
USCIS changed the filing locations for Form I-765 on October 7, 2026, and will accept packages sent to a prior location if postmarked on or before November 9, 2026. As of October 14, 2026, the Direct Filing Addresses page lists the following for C26.
| If your spouse's most recent I-129 receipt number begins with | U.S. Postal Service | FedEx, UPS, DHL |
|---|---|---|
| EAC, LIN or MCT | USCIS, Attn: H4, P.O. Box 660921, Dallas, TX 75266-0921 | USCIS, Attn: H4 (Box 660921), 2501 S. State Hwy. 121 Business, Suite 400, Lewisville, TX 75067-8003 |
| WAC, SRC or IOE | USCIS, Attn: H4, P.O. Box 20400, Phoenix, AZ 85036-0400 | USCIS, Attn: H4 (Box 20400), 2108 E. Elliot Rd., Tempe, AZ 85284-1806 |
USCIS's H-4 page gives the same destination, the lockbox on the I-765 addresses page, whether you file the I-765 alone or with a Form I-539. If you file with both the I-539 and your spouse's Form I-129, all three go to the service center that has jurisdiction over the I-129. Addresses change, so confirm on uscis.gov/i-765-addresses before mailing.
Three ways to file, and what each means for timing
| Filing | When it fits | USCIS posted time for the I-765 (80% of cases, October 14, 2026) |
|---|---|---|
| I-765 alone | Your H-4 status is already approved through the period you need | 17.5 months |
| I-765 with I-539 | You are extending H-4 or changing to H-4 | 6.5 months |
| I-765 with I-539 and the spouse's I-129 | H-1B extension, amendment or change of employer | 6.5 months (same C26 "filed with I-539" category) |
USCIS will not decide the I-765 until the I-539 is decided. There is no premium processing for either form in H-4 cases. Our hub on H-4 EAD processing time explains these figures and how to read them.
Mistakes that get H-4 EAD filings rejected or delayed
- Wrong or outdated fee. USCIS says it "will reject any application that is not accompanied by the proper filing fees or signature."
- Wrong form edition or mixed pages. All pages must come from the same accepted edition.
- Filing C26 together with a Form I-485. If you are filing for adjustment of status, the work permit category is (c)(9), not (c)(26). USCIS says it will reject an I-485 sent to the C26 address and may reject the I-765 too if both fees are on one payment.
- Missing proof of the basis. No I-140 approval notice and no AC21 evidence is the classic trigger for a request for evidence.
- Old address on file. The card is mailed by USPS Priority Mail. Update your address with both USCIS and USPS if you move.
- Working too early. USCIS is explicit: "You will not be authorized to work until USCIS approves your Form I-765."
After approval
USCIS says the card "should be produced within 2 weeks" of approval and is sent by USPS Priority Mail; it asks you to allow 30 days from approval before reporting a missing card. The tracking number appears in Case Status Online. If a card arrives with an error that USCIS made, you do not pay again to correct it. See checking H-4 EAD status for what each case status means.
Renewing later
A renewal is a new Form I-765 with the same category, a new fee and updated evidence, including your latest I-94 and a copy of the current card. USCIS generally recommends filing up to 180 days before the card expires and does not postdate a renewal to start when the old card ends. Since October 30, 2025, a pending renewal does not extend an expiring H-4 EAD. The rules and a planning timeline are in H-4 EAD renewal and automatic extension.

Could the rules change?
The H-4 EAD rule survived a decade of litigation, ending with the Supreme Court's refusal to hear Save Jobs USA v. DHS on October 14, 2025. DHS has since listed a possible rule to remove H-4 spouses from the eligible classes as a long-term action with no date. As of October 14, 2026, no proposal has been published and USCIS continues to accept C26 filings. Follow the dated record in H-4 EAD news.

Frequently asked questions
Who is eligible for an H4 EAD?
The H-4 spouse of an H-1B worker who is the principal beneficiary of an approved Form I-140, or who has been granted H-1B status beyond six years under AC21 sections 106(a) and (b). H-4 children and spouses of H-1B1, H-2A, H-2B or H-3 workers are not eligible.
What is the H4 EAD fee in 2026?
The Form I-765 filing fee is $520 for paper filing and $470 online on USCIS's G-1055 fee schedule dated October 7, 2026. Category C26 is not among the categories USCIS lists for online filing, so H-4 applicants should plan on $520. Renewals cost the same.
What documents are required for H4 EAD?
Proof of H-4 status (I-94 or I-539 approval notice), a government photo ID, your marriage certificate, proof of the basis (the I-140 approval notice or AC21 evidence), your spouse's latest I-797 for Form I-129, two 2-by-2-inch passport photos, and certified English translations of foreign-language documents.
Can I file H4 EAD online?
As of October 14, 2026, USCIS's list of Form I-765 categories that can be filed online does not include (c)(26). H-4 EAD applications are mailed to a USCIS lockbox, or to the service center handling the H-1B petition when filed together with Form I-129.
Can I work for any employer with an H4 EAD?
Yes. The C26 EAD is not tied to a sponsoring employer or occupation. Holders can change jobs, work part time, hold more than one job or be self-employed while the card is valid.
How long is an H4 EAD valid?
USCIS says the card's expiration date should match the expiration date of your most recent H-4 Form I-94, which normally tracks your spouse's H-1B approval. That is usually up to three years.
Can I apply for H4 EAD while my H-4 extension is pending?
Yes. USCIS allows Form I-765 to be filed together with Form I-539, or with both the I-539 and the spouse's Form I-129. It will not decide the I-765 until the I-539 has been adjudicated.
Where can I download the I-765 form?
The current Form I-765 PDF and instructions are free at uscis.gov/i-765. As of October 14, 2026, USCIS is accepting the 08/21/25 edition and is not accepting the 09/15/26 edition because of a court order.
